  • Due Diligence for Officers

Australia's Model Work Health and Safety Act sets out a legal framework designed to bring a consistent national approach to workplace health and safety.

Part of this framework includes a set of legal duties and responsibilities specifically for Officers of a Person Conducting a Business or Undertaking (PCBU). A PCBU is the term in the WHS Act used to describe an individual or organisation operating some kind of business or undertaking. Examples of a PCBU in a Church environment could include a diocese, a school, a religious order, and even a parish sporting club.

Officers must take responsibility for identifying and managing workplace hazards and risks. In the WHS Act this obligation is called due diligence. An Officer can be held personally liable for a failure to comply with his or her due diligence obligations.
